OFFICIAL RULES
$1,000,000 Pre-Tournament Picks Contest
- You must give a valid first and last name and a valid e-mail address when registering in order to qualify for any prize. Only one entry per household, per person, and/or per e-mail address is allowed. Peak Entertainment™ reserves the right at its sole discretion to disqualify any individual who was determined to have submitted multiple entries, tampered with the entry process, or has otherwise acted in violation of these Official Rules. You must use the official entry form located on the http://www.PeakEntertainment.com web site.
- All entries must be submitted no later than seven days prior to the announcement of the field of teams in the 2004 NCAA Division I men’s basketball tournament (this will be determined as seven days prior to the beginning of the televised show aired by CBS at 6:30 PM EST on Sunday, March 14, 2004). Any and all entries submitted after this time shall be null and void. The official time of the entry will be the time stamp of Peak Entertainment's entry validation server located in Antigua.
- In case of any ties, the prize money will be split evenly among the winners. In the case of a tie for a vacation package or merchandise, the monetary value of the prize will be split evenly among the winners. Peak Entertainment or its agents may use the name and likeness of the winner for promotional purposes without further compensation to the contest winner(s). The winner(s) agree to allow their name and likeness to be used in advertising in television, radio, magazines, newspapers, Internet sites and such similar media as a condition for payment of any of the prizes.
- Cash prizes will be awarded based on the number of correctly predicted teams, in each region with their correct seeding in the 2004 NCAA Division I men’s basketball tournament, as follows:
- 0-5 teams correctly predicted: One entry into vacation drawing (see below)
- 6-10 teams correctly predicted: Three entries into vacation drawing
- 11-15 teams correctly predicted: Five entries into vacation drawing
- 16 teams correctly predicted: $5 and five entries into the vacation drawing.
- 17-21 teams correctly predicted: $10 and five entries into the vacation drawing.
- 22-24 teams correctly predicted: $25 and five entries into the vacation drawing.
- 25 teams correctly predicted: $50 and five entries into the vacation drawing.
- 26 teams correctly predicted: $250 and five entries into the vacation drawing.
- 27 teams correctly predicted: $1,000 and five entries into the vacation drawing.
- All 28 teams correctly predicted: Super Grand Prize

Vacation package shall only include airfare, hotel accommodations, and airport ground transportation. The stay will be five days and four nights at The Blue Water Hotel in Antigua. Vacation must be taken after June 1st but before December 31, 2004. If the vacation drawing winner is unable to take the trip during this time, he/she will be disqualified and an alternate vacation drawing winner will be selected. Some restrictions may apply. Actual value of trip varies based upon point of departure and airfare fluctuations. Any difference between stated approximate retail value and actual value of prize will not be awarded.
- Super Grand Prize winner may be flown to the beautiful island of Antigua, including airfare, hotel accommodations, and airport ground transpiration. Super Grand Prize winner is solely responsible for all other expenses not specifically set forth herein including meals, gratuities and other incidentals. The Super Grand Prize trip must be taken after June 1st but before December 31, 2004. If the Super Grand Prize winner is unable to take the trip during this time, he/she will be disqualified and an alternate Super Grand Prize winner will be selected. Some restrictions may apply. Actual value of trip varies based upon point of departure and airfare fluctuations. Any difference between stated approximate retail value and actual value of prize will not be awarded. Super Grand Prize Winner will be awarded $1,000,000 in the form of 40 yearly payments of $25,000 each, without interest.
- Approximate retail value of Super Grand Prize (U.S. Dollars): $440,418
- All cash prizes other than the Super Grand Prize, will only be given in the form of a credit to a valid e-cash at any
Peak Entertainment brand.
- All entrants and winners agree to be bound by the Official Rules and by the decisions of the judges, which are final and binding in all respects. Winners will be notified by e-mail. If notification is returned as undeliverable, such prize will be forfeited, with an alternate winner selected. Super Grand Prize winner will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release (where legal) within 5 days of attempted notification. Grand Prize winner must execute and return a Release of Liability and a Publicity Release (where legal) prior to issuance of travel documents. In the event of non-compliance with these requirements, prize may be forfeited and an alternate winner selected.
- Super Grand Prize winner is responsible for all applicable federal, state and local taxes on prize. No prize substitution or cash equivalent of prize, except as provided herein. Prizes are not transferable. We reserve the right to substitute prize in our sole discretion due to prize unavailability, for any reason, and then only for a prize of equal or greater value. All cash prizes, with the exception of the Super Grand Prize, will only be paid to a Cryptologic e-cash account. Winners can open a Cryptologic e-cash account at any Peak Entertainment gaming property. See website http://www.PeakEntertainment.com for details.
- Employees, officers and directors of Peak Entertainment™, their parents, affiliates, subsidiary companies, vendors, sub-contractors or suppliers, and their advertising and promotional agencies, the immediate family (spouse, parents, children, and siblings, regardless of where they live) or members of the same households of such employees, and directors (whether or not related) are not eligible to participate. Any entrant who is proven to be related to, conducts business with, or has any sort of relationship, casual, professional or otherwise, with a member of the NCAA Division I men’s basketball selection committee, to be a player or coach of any team that participates in the 2004 NCAA Division I men’s basketball tournament, to be a member of the immediate families (immediate family is defined as parent, sibling or any person residing in the same household as employee or consultant) of a player or coach of any team that participates in the 2004 NCAA Division I men’s basketball tournament, to be an official who referees the games, to be a member of the immediate families of an official who referees the games, to be a paid employee of the NCAA, or to be a member of the immediate families of a paid employee of the NCAA will be ineligible to participate in this contest and will not be eligible for any prize or cash award.
- If for whatever reason Peak Entertainment is no longer able to host this Contest, NO winner will be named, NO prize will be awarded, and Peak Entertainment will not be liable for ANY damages that entrants may suffer.
- Peak Entertainment is not responsible for typographical or other human or technical errors in the offer or administration of this contest, including but not limited to errors in advertising, the Official Rules, the selection and announcement of the winner or the distribution of the prizes.
- Peak Entertainment in its sole discretion, may disqualify any entrant from participating in the contest, refuse to award points or prizes, and require the return of any prizes, if entrant engages in any conduct Peak Entertainment deems to be improper, unfair or otherwise adverse to the operation of the contest or detrimental to other entrants. Such improper conduct includes, but is not limited to, falsifying personal information required during contest registration or prize claim, violating any term or condition stated herein, accumulating points or prizes through methods such as automated computer scripts or other programming techniques, allowing others to use the entrant's personal information for the purpose of accumulating points or prizes, tampering with Peak Entertainment administration of this promotion, or intentionally trying to defraud, reverse engineer, disassemble, decompile or otherwise tamper with the computer programs on this web site. Entrant further acknowledges that the forfeiture of prize(s) and/or return of any prize(s) shall in no way prevent Peak Entertainment from pursuing other avenues of recourse such as criminal or civil proceedings in connection with such conduct.
- Peak Entertainment reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the contest. This contest is not affiliated with or endorsed by the 2004 Division I Men's College Basketball Tournament or any team playing in such tournament. This is a skill contest designed to increase consumer awareness of and interest in the products and services offerd by Peak Entertainment.
- Peak Entertainment will not be liable for any technical glitches, computer malfunction, Internet abnormality, act of God or nature, force majeure, or transmission problem of any kind. Any entry that has NOT been received with a time stamp from the Peak Entertainment server, will not be eligible.
- The Prize must be accepted as awarded and cannot be transferred. Void where prohibited by law. Only persons 18 years or older are eligible to participate in the contest. We reserve the right to add or amend rules for this contest.
- By participating in this Contest, all entrants and winners release Peak Entertainment, and each of their distributors, respective affiliate companies, parents, subsidiaries, affiliates, and the directors, officers, employees and agencies of same, from any and all liability for any injuries, losses or damages of any kind arising from his/her any travel related thereto or attendance at a public event.
